How to File a Complaint
Complaints must be submitted to the Texas Behavioral Health Executive Council on an approved complaint form, which may be downloaded from the Forms and Publications webpage or by clicking on the link below. Alternatively, you may call or write and request that the complaint form be mailed to you.
It is important to realize that by signing the complaint form, you are waiving confidentiality, as it is necessary for the Enforcement Division to review your complaint.
Request for Client Records
To request a client's healthcare records from a counselor in Texas, you must submit a signed, written request detailing the specific records needed, the client's name and date of birth, and where to send them. Texas law requires these requests to be in writing. Providers may charge a reasonable fee for copying and may require proof of identity.
- Submit a Written Request: Send a formal letter or email to the counselor
- Include Key Information: Provide the client's full name, date of birth, your contact information, the specific records (or date range) needed, and the delivery method (mail or secure email).
- Provide Authorization: If you are a third party (attorney, family member), include a signed authorization from the client.
- Identification: Provide a copy of a valid photo ID.
- Timing and Fees: Requests are typically fulfilled within 15 business days. Texas law allows providers to charge reasonable fees for copying and, if required, preparing a summary of the records.
